How long does Capgemini retain your information?
Capgemini does not retain your personal data any longer than is necessary for the purpose(s) for which it was first collected. Capgemini determines the appropriate retention period, taking the purpose(s) of the processing and relevant applicable legal requirements into account.
This means that the retention period may be defined differently depending on the purpose(s) of the processing and local requirements, taking specific legal obligations into account. In any case, and as described below, you can exercise your rights to gain access to your personal data, object to the processing of your personal data or request rectification or removal of your personal data.
Whow has access to your personal information?
1. With other group entities
Capgemini is a global organization. As such, various entities of the group may access and further process your personal data. However, this access will always be strictly limited to the relevant stakeholder(s), both from a functional and a geographical perspective.
Please note that all processing activities performed by Capgemini, including cross-border transfers of personal data, are subject to Capgemini’s Binding Corporate Rules (BCR). Capgemini’s BCR comprise both the EU and UK BCRs.
Capgemini’s BCR for the EU were first approved by European data protection authorities in March 2016 and then updated in January 2019 to comply with the General Data Protection Regulation (GDPR). Capgemini’s BCR for the EU were last updated in April 2023 to comply with additional data-transfer obligations. As group data protection policies, Capgemini’s BCR are legally binding for all Capgemini entities and their employees and provide a strong standard of protection for all personal information that Capgemini processes on its own behalf and on behalf of its clients.
2. With third parties
Capgemini may share your personal data with third parties from time to time and only if this is strictly necessary. If Capgemini shares your personal data with third parties, this will be done in accordance with applicable data protection legislation. In the event of cross-border transfers of personal data, these transfers are framed by the appropriate data transfer mechanism(s). In particular, wherever the GDPR is applicable, Capgemini will conclude Standard Contractual Clauses (SCC) approved by the European Commission to frame cross-border data transfers to countries that do not benefit from a European Commission adequacy decision.
3. With judicial, public and/or law enforcement authorities
We may also be obligated – by law, legal proceedings, litigation and/or requests from public and/or law enforcement authorities – to disclose your personal information. Please note that any such disclosure will be made only after Capgemini has carefully assessed and determined the legality and legitimacy of the request, as provided for in our internal policy.
